A legal dispute over Test fast bowler Brett Lee's involvement in a nationwide advertising campaign for a wireless broadband network is to go to mediation.
Lawyers acting for Cricket Australia have issued an application in the Federal Court seeking to restrain Unwired Australia Pty Ltd from continuing to use the player's image in its promotion activities.
The campaign uses the slogan: "No Wires, No Wait, No Worries".
But Geoffrey Sher, QC, told the court that the advertisements had never been approved by Cricket Australia and "were no longer approved by Brett Lee".
Justice Shane Marshall, after hearing submissions, set the case down for a mediation hearing before a registrar of the court next Tuesday.
If mediation fails to resolve the case, a trial date will be fixed.
Cricket Australia has stated that Unwired is a direct competitor of Hutchison 3G Australia, a major sponsor of the Australian team from 2001.
